Engagement of Services
The client has engaged the services of Premium Domestic to procure services on the terms and conditions set out below.
Suitability of Candidate
Premium Domestic shall use its best endeavours to ensure that the candidate presented to the client are suitable for the client’s needs.
Permanent Placement fee
Our fee is calculated as a percentage of the employee’s annual salary. This is due and payable before or on commencement of employment. Our fee is 10% of the annual salary. This once off fee is payable by the employer and there is no charge to prospective employees. Employment of a candidate referred by Premium Domestic Services will be deemed to be acceptance of our terms and conditions.
Temporary/Part time placement fee: R2000
Consultation (including shortlisting but no placement) – R550
Casual cleaners – R400 per day
OUR WARRANTY Premium Domestic Services warranty is subject to validation, which is by full payment being made before or on commencement of employment. The warranty is not valid where the candidate is no longer employed due to termination owing to operational requirements, unfair labour practices or breach of contract with the employee.
REPLACEMENT Premium Domestic Agency undertakes to replace the employee with a candidate willing and able to fulfil the same tasks and duties as in the original employee’s contract. Should the employee not prove satisfactory then we will be pleased to provide a replacement at no further charge during the warranty period of ninety (90) days.
Should the candidate leave the client during the first 3 months of the placement period, Premium Domestic as soon as is reasonably possible in the circumstances, will find a replacement. Should the replacement leave the client within the first 3 months of the original au candidates placement period, Premium Domestic shall have no further obligation to find another replacement, unless otherwise agreed in writing by the client and Premium Domestic. Whereas every effort is made to replace the employee as soon as possible, Premium Domestic Agency undertakes to replace the employee within 7 days of the employee leaving or being advised that a replacement is required.

Premium Domestic Services does not accept liability for any act or omission which might result in loss of or damage to your property.
Information, damages, and indemnity
In selecting the candidate, Premium Domestic has relied on the information supplied by the candidate and the information obtained from references supplied by the candidate. Premium Domestic has relied on such information in good faith and has passed on such information to the client in good faith. Premium Domestic shall bear no liability whatsoever for any loss or damage suffered by the client, directly or indirectly, arising from the employment with the client. If the employee suffers any loss, injury or damage arising out of her employment with the client, the client hereby indemnifies Premium Domestic in respect of any claims made against Premium Domestic as a result of such loss, injury or damage by the au pair or by any other person.
Cancellation
Should a candidate have been placed with the family and for whatever reason and the family decides to cancel the placement, after agreeing to hire, a cancellation fee of R1000.00 (one thousand rand) will become due and payable immediately upon cancellation.
Should this fee not be paid in full on cancellation and the account is handed over for collection, the client will, in addition to the cancellation fee be responsible for all legal costs incurred.
Refund of Placement Fee
The placement fee is non-refundable, but will be considered refundable in exceptional circumstances, determined by Premium Domestic in its sole discretion, if the following have been met:
a)The full placement fee has been paid within 7 days of placement.
b)The client affords Premium Domestic sufficient notice in writing as well as sufficient time to source and find a replacement and a replacement has not been found.
c)Where the working hours and job specifications are identical to the original specification given to Premium Domestic.
Non circumvention and confidentiality
The client acknowledges and undertakes that:
(a) the personal information (including contact details) of the candidate are to remain confidential and shall not be passed on to third parties with a view to or for the purpose of the candidate obtaining employment with that third party;
(b) the candidate has entered into an agency contract with Premium Domestic and by procuring employment for the candidate without going through the agency of Premium Domestic, the client will be causing financial loss to Premium Domestic and will further be causing the candidate to breach her contract with Premium Domestic.
(c) a breach by the client of this provision of the contract will be the basis of a claim by Premium Domestic against the client for the amount of the placement fee not paid to Premium Domestic, together with any other damages which it may have suffered including interest and legal costs;
(d) the client undertakes to treat all information supplied by Premium Domestic about candidates as confidential and not to pass such information on to any third party, unless strictly required for the candidate to carry out her obligations to the client.
